Terms and Conditions

This Limited Warranty (“warranty”) shall be subject to following stipulations and conditions:

1. This warranty only applies to the product namely “RHINO STAR” of ARL validly purchased by the purchaser from an authorized distributor/retailer as supplied by ARL and installed for specified purposes within the Indian territory and not otherwise.
2. The warranty shall be valid and applicable for roofing and cladding end application only; wherein the installation is at an incline of not more than 75° from the vertical.
3. This warranty shall not be valid or applicable or extend to or cover in respect of the following;
1. Installed above 900 meters from sea level.
2. stored or installed in a way which allows contact with animal and / or animal waste or its decomposed products
3. Any claim arising due to failures to remove debris and/or failure to provide free drainage of water including internal condensation from all surfaces of the product
4. Any claim arising due to misuse, willful act / or negligence and footage on erected sheeting/cladding
5. Damages to the products or the paint occasioned, directly or indirectly, by moisture or other contaminations detrimental to the product because of improper storage, packaging, shipping, handling, processing or forming of the product prior to installation.
6. Water damage to the products, directly or indirectly, due to condensation caused by improper storage, handling, processing, forming or packaging of the products prior to installation
7. Products which have suffered scratching or abrasion or impact by a hard object, has been abused, altered, modified, used in a manner not originally intended or stored contrary to instructions of ARL.
8. Non-uniform color changes that results from unequal exposure of roofing, sidewall or trim panels to sunlight and /or the elements are not covered by this warranty unless such color change meets the definition of the color change as mentioned in ‘Annexure-1: Definitions’
9. Product stored in uninstalled form for a period exceeding over 6 months from the date of purchase stamped on this warranty certificate
10. Cut edges and additionally made openings, tension bends etc. during erection / installation.
11. Uniform change of colour, fading of coating colour, changes in coating colour caused by dust and changes in gloss of coating.
12. Coating damage caused by severe reverse bending, forming which subjects coating to alternate compression and tension or improper roll forming, abrasion, scouring or cleaning procedures.
13. Presence of damp insulation or corrosive material in contact with or in close proximity to the product
14. Product deterioration due to direct/indirect contact with chemical fumes, before, during or after use.
15. Deterioration caused by direct or indirect contact with fasteners or sealants. All associated components are recommended to be coated products like Al-Zinc or Colour Coated GL.
16. Deterioration caused by use of improper fastener material other than that complying to AS 3566 Class ¾ or equivalent.
17. The warranty does not cover the back side of the coated product
18. This limited warranty does not extend to, or cover damage to the product occasioned by improper installation of the Coated Metal (NCCA guidelines described in the series titled “How to fabricate Pre-paint”)
19. Warranty is not applicable if guard film is not removed at the time of installation.
4. This warranty applies only to the products which have been exposed to normal weather conditions and not to the varied conditions encountered within one kilometer of ocean or air contaminated with chemical fumes, industrial pollutants, fumes or deleterious gases, ammonia, chlorine, saltpeter, ash, cement dust, carbon black, salts or other chemical sunstance or high continuous humidity.
5. ARL reserves its absolute discretion and rights on deciding condition of exposure and the type of environment, which decision of ARL shall be final and binding on the customer.
6. Surfaces of the installations must be freely exposed to washing by rainfall and kept clear of accumulated dirt and debris.
7. Water logging on roofs must be avoided and overlaps must be adequately sealed to prevent ingress of water.
8. End user customer must clean the installed sheets on a regular 6 months basis.
9. The coated metal must not be cleaned with abrasive or chemical cleaners.
10. Do not allow contact of coated steel product with incompatible material that includes lead, copper, bare steel, green or chemically treated timber, wet or dry concrete, soils, vegetable matter, any material which will inhibit normal exposure to the atmosphere
11. This warranty specifically excludes from its coverage any defects or failures in the exterior durability standards of the product caused by any force majeure events including acts of God (earthquake, fire, storm, floods, torrential rain, cyclone, hailstorm), falling objects, external force, explosions, fire, riots, civil commotions, acts of war, radiation, harmful gases or fumes, chemicals or foreign substances in the air or atmosphere.
12. This limited warranty shall be valid only if it is duly signed, sealed and stamped by an authorized distributor/trader of ARL with the date of purchase stamped on this warranty certificate.
13. In event of claim under this limited warranty, purchaser must provide original copy of following:
• Purchase Receipt
• Duly stamped warranty certificate

In addition, the purchaser shall demonstrate to reasonable satisfaction of ARL that the failure to the product was due to a breach of the limited warranty stated herein.

14. The exclusive remedy under this warranty shall be, at the sole discretion of ARL, to either
1. Repaint the Products; or
2. Provide free of charge replacements (but not installation) of the product with defective paint.

The purchaser agrees that liability of ARL is restricted as stated in (i) and (ii) above and shall be sole and exclusive remedy of the purchaser and no other claim for money or otherwise against ARL and ARL assumes no other liability or claims or responsibility whatsoever

15. Any repainted or replaced products shall be subject to this Warranty only for the unexpired period of Warranty applicable to the original genuine product RHINO STAR validly purchased by the purchaser.
16. ARL shall not in any event be liable for any special, indirect or consequential loss or damages including any claim for loss of profit or business or otherwise to anyone due to the Products with defective paints.
17. ARL extends this warranty solely to the original purchaser of the product. This Warranty is non-transferable and non-assignable.
18. ARL reserves the right to terminate this warranty at its sole discretion at any time without a written notice.
19. After expiration of the Warranty Period, this Warranty shall be deemed automatically extinguished forthwith and thereafter no claim shall lie or be acknowledged
20. This limited warranty shall be governed by and interpreted in accordance with Indian Laws and the courts of Kolkata shall have exclusive jurisdiction with respect to all matters arising from this Warranty between the parties.

Annexure-1: Definitions:

1. Film Integrity shall be defined as the absence of peeling, chalking, chipping or cracking, except for such crazing or slight cracking as may occur on tightly roll-formed edges or brake bends at the time of forming pre-painted sheet.
2. Color Change shall be defined as freedom from fade or change as mentioned in Table 1 in terms of Delta E units. Delta E unit is calculated in accordance with ASTM D 2244-93, CIE “L”, “a” “b”, 10 degree Observer, specular included. Color change is measured on an exposed painted surface that has been cleaned of surface soil and chalk and compared to corresponding values measured on the original or unexposed coated surface.
3. Chalk shall be defined as a numerical rating as warranted and measured in accordance with the standard procedures specified in ASTM D 4214-98
